APPLICATION FOR EARLY HEARING

 BEFORE THE HON’BLE COURT OF METROPOLITAN MAGISTRATE, WEST DELHI JUDICATURE AT TIS HAZARI, NEW DELHI 

Case No. 1311 of 2022 

IN THE MATTER OF: 

ABHIJIT GIRI …COMPLAINANT VERSUS 

SUJAL PATEL AND ORS …ACCUSED 

APPLICATION ON BEHALF OF THE COMPLAINANT FOR SEEKING AN EARLY HEARING 

MOST RESPECTFULLY SHOWETH: 

1. That the above-mentioned case is pending adjudication before this Hon’ble Court and is now fixed for hearing on 13.02.2023. 

2. That the Applicant had moved an application for Complaint against the Accused for Publishing or Transmitting of material containing sexually explicit act. 

3. That the application filed by the Complainant on 11.10.2022 was heard and an order for further hearing on the application was given on 22.12.2022 and the next date of hearing is fixed on 13.02.2023.

4. That under the above-mentioned circumstances, the Complainant prays for an early hearing of the case as the Accused persons have been constantly trying to contact the Complainant to withdraw the case or else he will have to face the consequences. 

5. That the Accused persons are not interested in the speedy disposal of this case and is intended to harass the Complainant. 

6. That the principle of natural justice equity and good conscience demands that the matter may be heard earlier and no purpose will be served in keeping the matter pending for 13.02.2023. 

7. That if the present application is not allowed then the Complainant will have to suffer irreparable loss and injury which cannot be compensated by any means whatsoever.

PRAYER 

In view of the facts and circumstances mentioned above it is prayed that this Hon’ble Court may kindly be pleased to 

a. List the matter earlier for hearing for proper adjudication of the case, in the interest of justice. b. Pass any order this Hon’ble Court may deem fit and proper, in favour of the Complainant.
