LEGAL NOTICE TO NOT REGISTER THE FIR  RELATING TO THE SAME CAUSE OF ACTION  WHICH IS ALREADY PENDING FOR ADJUDICATION  VIDE CASE No. 1311/2022 BEFORE THE COURT  OF LD. KAPIL KUMAR, TISHAZARI COURT, WEST  DELHI. 

Respected Sir,

 Under the instructions from and on behalf of my client  Mr. Abhijit Giri S/o Shri Asit Giri, R/o Jaijagannath  Apartment, IInd Floor, 15 Nilganj Road, North 24  Parganas, West Bengal-70011 also at C-6A-20A,  Janakpuri New Delhi-110058 (Communication Address  through counsel), address you and serve upon you this  notice the contents of which are as under: 

1. That my client is a law-abiding citizen, neither  involved in any activity which is illegal or against the  law of the land. That my client is residing at the  above-mentioned address. 

2. That as proceedings regarding the same cause of  action vide Criminal case No.1311/2022, pending  adjudication before the Court of Kapil Kumar Ld.  CMM, Tis Hazari Court, West Delhi, thereby no  purpose will be served in initiation of the same  proceedings over the same cause of action by  registering FIR in PS Khardah, Kolkata. 

3. That as the cause of action in the present case has  not arisen neither under the ambit or jurisdiction of  the Police Station Khardha, hence no purpose will be  served in registering an FIR regarding the same in PS  Khardah, Kolkata.  

4. That the purpose under which the noticee had filed  the present case vide case No.1311/2022 pending for  adjudication in the Court of Kapil Kumar Ld. CMM,  Tis Hazari Court, West Delhi, is not going to be 

served by again registering an FIR regarding the same  under the jurisdiction of PS Khardah, Kolkata.  

5. In view of the aforesaid facts, it will be totally futile to  initiate the proceedings again by registering an FIR  over the same cause of action in PS Khardah,  Kolkata. 

Hence you are requested to respond to this notice in  compliance with the aforementioned facts by not  registering the FIR accordingly, since no assistance,  or investigation, or enquiry, or action is required from  Khardah PS, or any other police station in kolkata.
